Across the board, the Stanford research points that developers’ privacy policies lack essential information about their practices. UPDATE: On November 22, the update was added to the article basically saying that Google’s recent wording change around Gmail “smart features” caused major confusion — including early reports suggesting emails were being used to train Google’s AI models by default. After reviewing Google’s documentation, the author of the article concluded that “it doesn’t appear to be the case”. Gmail does scan content for built-in features like spam filtering and suggestions, but that is supposedly separate from training generative AI. 🤔 “… doesn’t appear to be the case” is the operative phrase in that update… Isn’t it? (Link to the updated source is in the comments). 🚨 Heads-up, cyber friends: your inbox might be humming with more than just deadlines. According to Malwarebytes, Gmail is automatically opting you in to have all your emails and attachments used for training its AI models. Unless you manually opt out, your private correspondence may now be fueling AI-features behind the scenes. Here are the key takeaways: 🔍 Opt-in by default matters — Instead of asking you first, the service assumes consent. This flips the script on personal privacy: it’s no longer “do you want to participate?” but “you are participating unless you act.” That shifts the power and — for many — erodes trust. 🤖 Training AI on consumer data without explicit consent is becoming a worrying trend. Using everyday user content (emails, attachments, chats) to refine AI models means personal information is being repurposed in unexpected ways. This approach emphasizes "privacy by default" and the need for technical standards and infrastructure that enable meaningful consent mechanisms. 2.) Focus on the AI Data Supply Chain: Enhance privacy and data protection by ensuring dataset transparency and accountability throughout the entire lifecycle of data. Once viewed primarily as a compliance steward for the General Data Protection Regulation (#GDPR), the DPO is now emerging as a central #architect of digital governance. This evolution is driven by the convergence of multiple EU regulatory frameworks: namely the #NIS2 Directive, the Digital Operational Resilience Act (#DORA), and the #AIAct, just to name the most relevant, and each introducing new layers of accountability, risk management, data governance and ethical oversight. Together, these instruments form a complex regulatory ecosystem that demands a multidisciplinary approach. The modern DPOs are no longer just legal compliance officers, they now operate at the dynamic crossroads of #law, #cybersecurity, operational #resilience, and AI #ethics. As digital ecosystems grow more complex, the DPO is evolving into a true #DataProtectionEngineer, equipped not only to interpret regulations but to architect privacy-aware systems. 📌This role demands a deep understanding of how emerging technologies such as AI, #IoT, #cloudinfrastructure, which affect the fundamental rights and freedoms of individuals. Without centralised coordination, organisations risk inconsistent compliance and exposure to regulatory sanctions. The DPO serves as the 'central figure' for harmonising these requirements across legal, technical, and operational domains. 2️⃣Accountability and Demonstrable Compliance Supervisory authorities increasingly demand evidence-based compliance. Organisations must maintain detailed records of data flows, AI development processes, and incident responses. The DPO must champion a culture of #accountability, supported by robust governance structures and documentation protocols. 3️⃣ Technical and Organisational Complexity DORA mandates rigorous digital resilience testing and ICT risk assessments. The AI Act imposes strict data quality, explainability, and human oversight requirements. These obligations require cross-functional collaboration and significant investment in infrastructure, training, and tooling. At the end of the day, the DPO must act as a change agent, fostering alignment between compliance, innovation, and business objectives. The challenge is formidable, but so is the opportunity to redefine the role as a cornerstone of ethical, secure, and forward-looking digital governance.

🇪🇺‼️The Der Gerichtshof der Europäischen Union has just issued its Grand Chamber judgment in Russmedia Digital (C-492/23), and it is in my humble opinion one of the most significant #GDPR rulings this year concerning on the responsibilities of online platforms under data #privacy law. ⚖️The Court concludes that an operator of an online marketplace is a data controller for the personal data contained in user-generated advertisements published on its platform. This applies even where the platform does not create or select the content and even where the advertiser is anonymous. The decisive factor is that the ad becomes public only because the platform chooses to make it accessible, and the operator can commercially exploit the published data. 💡On that basis, the Court examines the operator’s obligations through Articles 5(2), 24–26 and 32 GDPR. It holds that marketplace operators are joint controllers with users who upload advertisements, and that they must ensure compliance with the GDPR before an ad is published. The Court interprets data protection by design and the accountability principle broadly, leading to clear ex ante duties. The operator must identify whether an ad contains sensitive data in the sense of Article 9(1) GDPR, verify whether the advertiser is the data subject, and, if not, verify whether the data subject has given explicit consent. If explicit consent is not demonstrated and no other Article 9(2) exception applies, the platform must refuse publication. The judgment therefore establishes that controller obligations include proactive verification of identity and the lawfulness of sensitive-data processing. 💡The Court then links this preventive approach with Article 32 GDPR. Because once-sensitive data are online they can be copied widely and become difficult to erase, the platform must adopt appropriate technical and organisational measures to prevent or limit copying and unlawful re-publication by third parties. While GDPR does not require absolute security, it obliges controllers to consider tools that can technically hinder copying or automated extraction of content. This significantly expands the expected security posture of platforms hosting sensitive data. 📍The Court clearly departed from the Advocate General’s Opinion. AG Szpunar had proposed that marketplace operators act merely as processors and should not be subject to proactive identity or content verification duties. Instead, the Court adopted a far more expansive interpretation of controller responsibility, rejecting the AG’s narrower approach and imposing full ex ante obligations on platforms.
