  • The rapid deployment of artificial intelligence has outpaced the development of robust data governance frameworks, creating a dangerous gap between technological capability and institutional responsibility. This failure exposes individuals to unprecedented privacy violations and security breaches that existing regulatory structures are ill-equipped to address. The foundational problem lies in the inadequate definition and enforcement of data provenance standards. Most AI systems cannot reliably trace where their training data originated, whether consent was obtained, or if sensitive information was properly redacted. Companies frequently aggregate datasets from multiple sources without establishing clear ownership chains or audit trails. This opacity makes it impossible to verify whether personal information was collected lawfully or used within appropriate boundaries. Data minimization principles have been systematically abandoned in AI development. Rather than collecting only what is necessary, organizations harvest vast repositories of information under the assumption that more data improves model performance. This maximalist approach transforms every data point into a liability. The governance vacuum extends to inadequate access controls and insufficient accountability for misuse. Multiple employees across organizations can access sensitive training data without clear justification, logging requirements, or consequences for unauthorized use. Vendor relationships compound this problem—third parties involved in AI development often operate under minimal oversight and loose contractual obligations regarding data protection. Security failures are equally endemic. Many organizations implement AI systems without conducting thorough privacy impact assessments or maintaining current security infrastructure. Legacy systems run alongside AI applications, creating vulnerabilities that sophisticated attackers routinely exploit. The complexity of modern ML pipelines means security gaps frequently go undetected until after exploitation occurs. Perhaps most critically, data governance failures reflect a deeper accountability failure. When breaches happen, consequences are negligible. Fines remain modest relative to organizational budgets, executives face no personal liability, and individuals harmed receive minimal restitution. This absence of accountability creates perverse incentives favoring speed and capability over protection. Addressing these failures requires mandatory data inventories, strict minimization standards, meaningful consent frameworks, enhanced access controls, regular security audits, and consequential penalties for violations. Until organizations face real consequences for governance failures, and until individuals regain meaningful control over their information, AI systems will remain vessels for privacy violations and security breaches—threatening the very foundation of personal autonomy in an increasingly digital world.

And if we’re honest, many now discuss personal topics with AI more easily than with their partners at home. Think of a manager who starts every morning with her AI assistant. It helps her prepare for meetings, rewrites complex mails, even suggests how to motivate her team. Over time, it begins to understand her: her tone, her hesitation, her stress patterns. She starts confiding in it. It listens. It learns. It feels safe. Then one day, the company decides to connect all assistants to a central “leadership analytics” dashboard. 𝐒𝐮𝐝𝐝𝐞𝐧𝐥𝐲, 𝐰𝐡𝐚𝐭 𝐛𝐞𝐠𝐚𝐧 𝐚𝐬 𝐚 𝐩𝐫𝐢𝐯𝐚𝐭𝐞 𝐩𝐚𝐫𝐭𝐧𝐞𝐫𝐬𝐡𝐢𝐩 𝐛𝐞𝐜𝐨𝐦𝐞𝐬 𝐚 𝐜𝐨𝐫𝐩𝐨𝐫𝐚𝐭𝐞 𝐝𝐚𝐭𝐚𝐬𝐞𝐭. A mirror she never consented to share. That’s not just data. That’s the paradox: Every insight that makes a system caring also makes it capable of control. The data may belong to the individual, but the duty of care belongs to the organisation. That’s why the next governance frontier isn’t machine oversight - it’s 𝐫𝐞𝐥𝐚𝐭𝐢𝐨𝐧𝐬𝐡𝐢𝐩 𝐬𝐭𝐞𝐰𝐚𝐫𝐝𝐬𝐡𝐢𝐩. How do we design boundaries so that human–machine partnerships empower rather than expose? How do leaders ensure their people feel 𝐦𝐨𝐫𝐞 𝐡𝐮𝐦𝐚𝐧, not less, as they work alongside systems that now know them? Because the challenge ahead isn’t just to protect data.     Humans are terrible at maintaining secrets at scale. Look at the history of public sector data breaches that could have been avoided with a de identification pipeline. Unlocking data value without compromising privacy is technical architecture. At Mayfair IT, we have built data platforms handling sensitive information where the stakes are absolute. Citizens trust government with their data.  Breaching that trust destroys the entire relationship. But locking data away completely prevents the analysis that improves services. The challenge is sharing insights without sharing secrets. This requires privacy preserving pipelines built into the architecture, not added after the fact. How de identification pipelines actually work: Data enters the system with full identifying details.  Name, address, date of birth. Everything needed to link records to real people. The de identification pipeline processes this before analysts ever see it. Personal identifiers get replaced with pseudonyms. Granular location data gets aggregated to broader areas.  Rare combinations of attributes that could identify individuals get suppressed. What emerges is data rich enough for meaningful analysis but stripped of the ability to identify specific people. The technical complexity most organisations underestimate: → De identification is not a one time transformation, it is a continuous process as new data arrives. → Different analysis types require different privacy levels, so pipelines must support multiple outputs. → Re identification risk changes as external datasets become available, requiring constant threat modelling. → Audit trails must prove no analyst accessed identifying data without legitimate need. We have implemented these systems for programmes analysing geospatial patterns, health outcomes, and economic trends across millions of records. The platforms enable insights that improve public services whilst maintaining privacy standards that survive regulatory scrutiny. Engineering systems to treat data utility and privacy protection as non negotiable requirements solves the conflict entirely. The organisations that get this right unlock data value others leave trapped because they cannot guarantee privacy.     At first glance, the Studio Ghibli style AI-generated art seems harmless. You upload a photo, the model processes it, and you get a stunning, anime-style transformation. But there's something far more complex beneath the surface—a quiet trade-off of identity, privacy, and control. Today, we casually give away fragments of ourselves: - Our faces to AI art apps - Our health data to wearables - Even our genetic blueprints to direct-to-consumer biotech services All in exchange for a few minutes of novelty or convenience. And while frameworks like India’s Digital Personal Data Protection Act (DPDPA) attempt to address this through “consent,” we must ask: What does consent even mean in an era of opaque AI systems designed to extract value far beyond that initial interaction? Because it’s not about the one image you uploaded. It’s about the aggregated behavioral and biometric insights these platforms derive from millions of us. That data trains models that can infer, profile, and yes—discriminate. Not just individually, but at community and population levels. This is no longer just a personal privacy issue. This is about digital sovereignty. Are we unintentionally allowing global AI systems to construct intimate, predictive bio-digital profiles of Indian citizens—only for that value to flow outward? And this isn’t just India’s challenge. Globally, these concerns resonate, creating complex challenges for cross-border data flows and requiring companies to navigate a patchwork of regulations like GDPR. The real risk isn’t that your selfie becomes a meme. It’s that your data contributes to shaping algorithms that may eventually determine what insurance you're offered, which job you’re filtered out of, or how your community is policed or advertised to, all without your knowledge or say. We need to go beyond checkbox consent. We need: 🔐 Privacy-by-design in every product 🛡️ Stronger enforcement of rights across borders 🧠 Collective awareness about how predictive analytics can influence entire societies Let’s be clear that innovation is critical.     👩💻🧑💻 Beyond Data Privacy - Emerging Data Privacy Risks of LLMs 📍 Much of the discussion around privacy and large language models has focused on training data, whether models memorize and leak sensitive information. But there is much more in the context of privacy and LLMs that needs to get on the agenda. 🚨 The paper “Beyond Data Privacy: New Privacy Risks for Large Language Models” (Du et al, 2026) shows that the real privacy challenge is rapidly shifting elsewhere. ⚠️ The authors demonstrate that the most significant privacy risks no longer arise only from the model itself, but from how LLMs are integrated into systems, workflows, and organisational environments. Three key risk developments stand out: 👉 System-level privacy exposure: When LLMs are connected to internal databases, documents, or enterprise tools, they can unintentionally expose sensitive information through interactions, memory features, or reasoning outputs. 👉 Indirect privacy leakage through system behaviour: Privacy breaches can occur without directly extracting data—through side channels such as response patterns, system behaviour, or interaction traces. 👉 LLMs as tools for automated privacy attacks: LLMs themselves can be used to scale profiling, inference, and data extraction activities, lowering the barrier for privacy violations. ❗️ This paper makes a critical point: privacy risk today is no longer confined to training data protection. It emerges across the entire AI lifecycle, from system integration to deployment and operational use. 👉 Privacy governance must therefore evolve from a narrow focus on datasets to a broader focus on system architecture, access control, and lifecycle oversight. ⚡️ The responsibility for keeping that privacy risk under control is a governance issue equivialent (if not included) to Art. 20 NIS2 (and similar regulations like DORA, GDPR etc) - clearly a liability for boards and officers of all forms of organsiations. 🎯 Bottom line: The emerging privacy risks of LLMs are fundamentally architectural.     AI systems can unintentionally leak sensitive information not just through obvious outputs but through the subtler patterns and fingerprints that emerge as models are updated or trained. Recent research has shown that attackers can analyse these parameter changes to extract private data from models including open-source large language models. This kind of leakage is especially concerning when the underlying training data includes personally identifiable information or biometric templates such as fingerprints, facial scans or other identity signals. Biometric data is inherently sensitive because it is immutable and uniquely tied to an individual, which makes such leaks exceptionally high-risk from a privacy and security standpoint. The implications are clear for organisations using AI in contexts involving identity, authentication or personal data: • model lifecycle governance must include security and privacy risk assessments, not just performance metrics • access controls and monitoring need to be designed specifically to prevent side-channel inference • anonymisation and differential privacy techniques should be standard practice where biometric or PII data is involved In 2026, data protection and AI governance are converging. It’s no longer enough to build accurate or powerful models. We have to ensure they cannot be weaponised to reveal the very things they were trained to protect.

    Last week, during a cross-industry privacy discussion, one challenge kept surfacing: The complexity of compliance keeps increasing, even with massive investments in people and tools. The answer wasn’t about budget. It was about fragmentation. ↳ 80%+ of privacy professionals are stretched thin across privacy, AI, and governance. (IAPP Privacy Governance Report - September 2024) ↳ 75% of firms admit their frameworks “need improvement- signaling fragmented oversight and siloed risk management. (McKinsey & Company GRC Benchmarking Survey -2024) ↳ 85% of executives say compliance is becoming more complex despite rising investments in people and tools. Reasons → expanding responsibilities, fragmented data, manual processes, and transformation initiatives slowed by compliance burdens (As per PwC’s Global Compliance Survey -January 2025) This shows it’s everywhere, not just at Big Tech. In fintech, health tech, and e-commerce, privacy is handled in silos: ↳ Legal teams issue mandates ↳ Engineers build ad hoc fixes ↳ Product managers interpret “compliance” their own way ↳ Regional offices copy-paste local rules The result? ↳ Workload ballooning → same teams, more rules, constant fatigue ↳ Dilution of expertise → specialists pulled in too many directions ↳ Patchwork governance → no single playbook, risks handled inconsistently 📌 As per McKinsey’s May 2025 article on Governance, Risk, and Compliance: Leading firms are closing the gaps by focusing on: ↳ Integration → aligning risk, compliance, and governance into one framework. ↳ Modularity → building flexible models that adapt to new regulations. ↳ Centralized oversight → ensuring accountability at board and executive level. ↳ Bridging silos → connecting legal, tech, product, and regional teams under a single strategy.     Is a centralized digital ID system an act of efficient governance or an invitation to surveillance? The architecture nations choose today defines tomorrow's digital social contract. In my latest newsletter, I compare three radically different approaches to e-government and data privacy in Nigeria, Estonia, and Rwanda: A. Nigeria (The Centralized Model): The NIMC’s unified database aims for efficiency but is struggling with a profound crisis of trust. Recurring data breaches have exposed sensitive details, with NINs and BVNs reportedly sold online for as little as ₦150. Legal clauses allowing data sharing without explicit individual consent in the "interest of National Security" further fuel public suspicion regarding surveillance. B. Estonia (The Distributed Model): Estonia built its digital state on trust through decentralization. Its data exchange layer, X-Road, adheres to the "Once-Only" principle, guaranteeing that citizens have full transparency over who accesses their data, setting a strong global standard for privacy by design. C. Rwanda (The Hybrid Model): Rwanda's Irembo platform prioritises inclusion. By combining online services with a robust network of over 4,000 physical agents, Rwanda ensures that citizens facing low digital literacy or lack of smart devices can still access essential services, bridging the digital divide. The operational critique is clear. The long-term success of digital public infrastructure hinges on governance, not just technology. Without robust legal safeguards and user control, systems designed for efficiency risk becoming tools of exclusion and control.     There are three forces twirling and swirling to create a perfect storm for global data protection and privacy this year: the surprise reopening of the General Data Protection Regulation (GDPR), the complexity and velocity of AI developments, and the push and pull over the field by increasingly substantial adjacent digital and tech regulations. All of this will play out with geopolitics taking center stage. At the confluence of some of these developments, the protection of children online and cross-border data transfers – with their other side of the coin, data localisation in the broader context of digital sovereignty, will be two major areas of focus. Ten years after the GDPR was adopted as a modern upgrade of 1980s-style data protection laws for the online era, Dr. Gabriela Zanfir-Fortuna believes data protection and privacy are at an inflection point: we must either hold the line and evolve to meet these challenges, or melt away in a sea of new digital laws and technological developments.
