Ensuring compliance with #ISO42001, #ISO42005 (DIS), #ISO23894, and #ISO27701 (DIS) guidelines is now more material than ever. 1. Strengthening AI Management Systems (AIMS) with Privacy Controls 🔑Key Considerations: 🔸ISO 42001 Clause 6.1.2 (AI Risk Assessment): Organizations must integrate privacy risk evaluations into their AI management framework. 🔸ISO 42001 Clause 6.1.4 (AI System Impact Assessment): Requires assessing AI system risks, including personal data exposure and third-party data handling. 🔸ISO 27701 Clause 5.2 (Privacy Policy): Calls for explicit privacy commitments in AI policies to ensure alignment with global data protection laws. 🪛Implementation Example: Establish an AI Data Protection Policy that incorporates ISO27701 guidelines and explicitly defines how AI models handle user data. 2. They’re essential for regulatory compliance, stakeholder trust, and business resilience. 🔑 Key actions: ◻️Adopt AI privacy and governance frameworks (ISO42001 & 27701). ◻️Conduct AI impact assessments to preempt regulatory concerns (ISO 42005). ◻️Align risk assessments with global privacy laws (ISO23894 & 27701).   Privacy-first AI shouldn't be seen just as a cost of doing business, it’s actually your new competitive advantage.

  • The rapid deployment of artificial intelligence has outpaced the development of robust data governance frameworks, creating a dangerous gap between technological capability and institutional responsibility. This failure exposes individuals to unprecedented privacy violations and security breaches that existing regulatory structures are ill-equipped to address. The foundational problem lies in the inadequate definition and enforcement of data provenance standards. Most AI systems cannot reliably trace where their training data originated, whether consent was obtained, or if sensitive information was properly redacted. Companies frequently aggregate datasets from multiple sources without establishing clear ownership chains or audit trails. This opacity makes it impossible to verify whether personal information was collected lawfully or used within appropriate boundaries. Data minimization principles have been systematically abandoned in AI development. Rather than collecting only what is necessary, organizations harvest vast repositories of information under the assumption that more data improves model performance. This maximalist approach transforms every data point into a liability. The governance vacuum extends to inadequate access controls and insufficient accountability for misuse. Multiple employees across organizations can access sensitive training data without clear justification, logging requirements, or consequences for unauthorized use. Vendor relationships compound this problem—third parties involved in AI development often operate under minimal oversight and loose contractual obligations regarding data protection. Security failures are equally endemic. Many organizations implement AI systems without conducting thorough privacy impact assessments or maintaining current security infrastructure. Legacy systems run alongside AI applications, creating vulnerabilities that sophisticated attackers routinely exploit. The complexity of modern ML pipelines means security gaps frequently go undetected until after exploitation occurs. Perhaps most critically, data governance failures reflect a deeper accountability failure. When breaches happen, consequences are negligible. Fines remain modest relative to organizational budgets, executives face no personal liability, and individuals harmed receive minimal restitution. This absence of accountability creates perverse incentives favoring speed and capability over protection. Addressing these failures requires mandatory data inventories, strict minimization standards, meaningful consent frameworks, enhanced access controls, regular security audits, and consequential penalties for violations. Until organizations face real consequences for governance failures, and until individuals regain meaningful control over their information, AI systems will remain vessels for privacy violations and security breaches—threatening the very foundation of personal autonomy in an increasingly digital world.

    The EDPB recently published a report on AI Privacy Risks and Mitigations in LLMs.   This is one of the most practical and detailed resources I've seen from the EDPB, with extensive guidance for developers and deployers. The report walks through privacy risks associated with LLMs across the AI lifecycle, from data collection and training to deployment and retirement, and offers practical tips for identifying, measuring, and mitigating risks.   Here's a quick summary of some of the key mitigations mentioned in the report:   For providers: • Fine-tune LLMs on curated, high-quality datasets and limit the scope of model outputs to relevant and up-to-date information. • Use robust anonymisation techniques and automated tools to detect and remove personal data from training data. • Apply input filters and user warnings during deployment to discourage users from entering personal data, as well as automated detection methods to flag or anonymise sensitive input data before it is processed. • Clearly inform users about how their data will be processed through privacy policies, instructions, warning or disclaimers in the user interface. • Encrypt user inputs and outputs during transmission and storage to protect data from unauthorized access. • Protect against prompt injection and jailbreaking by validating inputs, monitoring LLMs for abnormal input behaviour, and limiting the amount of text a user can input. • Apply content filtering and human review processes to flag sensitive or inappropriate outputs. • Limit data logging and provide configurable options to deployers regarding log retention. • Offer easy-to-use opt-in/opt-out options for users whose feedback data might be used for retraining.   For deployers: • Enforce strong authentication to restrict access to the input interface and protect session data. • Mitigate adversarial attacks by adding a layer for input sanitization and filtering, monitoring and logging user queries to detect unusual patterns. • Work with providers to ensure they do not retain or misuse sensitive input data. • Guide users to avoid sharing unnecessary personal data through clear instructions, training and warnings. • Educate employees and end users on proper usage, including the appropriate use of outputs and phishing techniques that could trick individuals into revealing sensitive information. • Ensure employees and end users avoid overreliance on LLMs for critical or high-stakes decisions without verification, and ensure outputs are reviewed by humans before implementation or dissemination. • Securely store outputs and restrict access to authorised personnel and systems.   This is a rare example where the EDPB strikes a good balance between practical safeguards and legal expectations.     🔎 As we round off Data Privacy Week, one of the biggest risks companies are facing is not external. It is sitting on their own websites. At Dykema , my privacy team and I are seeing this risk show up daily in the form of demand letters and lawsuits tied to website technologies. We also recently covered these same issues on a Dykema panel on web tracking technologies (I will share the link in the comments). Tracking pixels, chat functions, and session replay tools are driving a surge in demand letters and class action litigation under state wiretapping and privacy laws. Companies are being accused of intercepting user communications without proper consent.     In a discussion with a data leader, we addressed a critical challenge: balancing data access with security. Their insights provided actionable strategies to empower teams while safeguarding sensitive information. 1. Access Isn’t a Free-for-All The CDO shared how their organization implemented Role-Based Access Controls (RBAC) to ensure data access was tailored to roles. “Marketing doesn’t need access to financial records, and HR doesn’t need customer trends,” they explained. This targeted approach enabled collaboration without unnecessary risks. 2. Secure, But Collaborative Sensitive data was another concern. “We needed to protect personal information but still allow teams to work with the data,” the CDO noted. They used masking techniques to anonymize sensitive details, letting teams analyze trends without compromising privacy. “It’s a win-win—we get insights and stay compliant.” 3. Training is Non-Negotiable The CDO emphasized the importance of fostering a culture of data responsibility. “We don’t just rely on tools; we educate our teams about data ethics and security. When people understand the risks, they make better decisions.”
