“I just needed help with a SQL query.” That is what a junior dev said after copying and pasting 200+ real customer records emails, phone numbers, and purchase history straight into ChatGPT. And the only reason anyone caught it was because a security lead walked past his screen. From a security engineering lens, that is not a tiny mistake. That is a textbook data leak to an unapproved third party. Dear junior engineers, if you do not want to end your career over an unintentional security and privacy breach, please understand this: An AI chat window is not your notebook. It is an external system, owned and logged by someone else. Treat it exactly like you would treat sending data to any random vendor. “Just one paste” can easily qualify as: - Unauthorized disclosure of customer data - Violation of internal policy and NDA - Reportable incident under GDPR, HIPAA, PCI, or local privacy law Intent does not matter to the regulator. Impact does. But here, the real problem is bigger than “they used ChatGPT” When a junior can copy live customer records into a browser, the gaps started long before AI. It usually means: - Devs have direct access to production data - No proper dev or test environment with fake data - Weak data classification and DLP controls - No clear AI usage policy, or it exists only as a PDF nobody reads Blocking one website will not fix that. We need a deeper approach. If you are building a serious security program around LLMs, here is the practical pattern I would recommend. 1. Provide a safe, approved AI option - Give people an org owned option: enterprise ChatGPT, Claude, Copilot, or an internal model behind SSO and RBAC. - Tell them clearly: confidential data belongs only in these tools. Otherwise they will use public ones anyway. 2. Block or tightly gate public LLMs - Use CASB or secure browser or proxy to detect and control access to public AI tools. - Use always on VPN so usage from home is still covered. - At minimum, block corporate accounts from using personal AI accounts for work data. 3. Enforce least privilege and environment separation - Junior devs should not touch live customer data. - Limit who can query real PII and under which scenarios. 4. Data classification that AI actually respects - Label sensitive tables, fields, and documents. - AI agents must only see what the logged in user is allowed to see. 5. Clear policy and training - Give concrete examples of what must never be pasted into public AI. - Make AI usage policy part of onboarding, refresh it often, and hold managers responsible. AI is an incredible tool. I use it daily. You should too. It will make you faster at debugging, learning, and designing systems. But “I did not know” will not protect you when your prompt shows up in an incident report. But here’s what most people don’t know (or forget to think about): ✅ Your data is stored by default. ✅ It can be viewed by OpenAI staff. ✅ It may be used to train future models. ✅ Deleting a conversation doesn't guarantee it’s gone forever. ✅ Even your creative or emotional prompts could end up influencing the AI’s behaviour. And no — this isn’t speculation. 📌 ChatGPT admits all this transparently in its own settings and help docs. Unless you turn off chat history, OpenAI may: · Store your chats · Review them (yes, real humans can) · Use your data to train the model 🧠 So, the next time you’re sharing that emotional journal entry, personal health update, legal draft, or internal company strategy… pause and ask: "Would I be okay if this were read by someone at OpenAI?" ⚠️ It’s not about paranoia — it’s about informed usage. A recent issue has emerged where private ChatGPT conversations, once shared, have become publicly searchable on Google. This is a huge red flag for HR. Conversations containing sensitive information, like employee personal details from CVs, confidential business plans, or even legal advice, are now potentially exposed. My key takeaways: ▶️ Data Privacy Nightmare: This isn't just a technical glitch; it's a massive data privacy risk. Imagine employee PII, performance review details, or internal strategy documents showing up in a public search. This could lead to serious breaches and legal repercussions under regulations like GDPR or state privacy laws. ▶️ Policy and Training Gap: The root of the problem is a lack of awareness. Employees are using AI tools without fully understanding the privacy and security implications. Last night, OpenAI’s CISO confirmed the company had disabled a short-lived feature that allowed some ChatGPT conversations to be indexed by search engines, following public concern over private material showing up in Google results. The discovery shocked many users. A simple site search query could reveal indexed ChatGPT conversations. These included surprising amounts of sensitive content, from discussions of confidential legal advice and business negotiations to personal CVs and job applications, often containing full names, company affiliations, and unredacted personal details. At the core of the issue was ChatGPT’s “Share” function. The tool generates a unique link to a conversation that can be passed to others. According to OpenAI’s Chief Information Security Officer Dane Stuckey in a twitter post, the feature briefly included an additional checkbox that allowed users to make shared chats discoverable by search engines. This, he said, was an experiment designed to help surface useful examples of AI conversations. But the results raised serious questions about user understanding and the boundary between private and public content in the era of generative AI. In many cases, it is unclear whether users realised their shared conversations could end up indexed and publicly searchable. Some affected chats were rich with commercially sensitive information, potentially impacting legal privilege and exposing private individuals to reputational or legal risk. It is still not known whether indexing affected only the free version of ChatGPT or also applied to paid plans. Nor is it clear whether every shared chat was exposed or only those explicitly marked for crawling. For now, what is known is that at least some conversations did appear on Google, and that OpenAI has now taken steps to stop it. In a statement posted to Twitter, Stuckey confirmed that the checkbox for making chats discoverable has been removed, and OpenAI is actively working to purge already-indexed content from search engines. The change is being rolled out across all user accounts. From a user literacy and privacy standpoint, the incident points to a far larger concern. People are increasingly turning to AI tools like ChatGPT for support with personal, professional, and legal matters. Yet the boundary between a private tool and a public web presence is easily blurred. It is a reminder that AI conversations, however informal, may deserve the same confidentiality protections as emails or documents. For legal professionals - if a client copies legal advice into a shared AI chat, and then shares it without understanding the risks, could that advice lose its protected status? The incident also serves as a wake-up call for businesses relying on generative AI. Any AI policy or acceptable use framework should include clear guidance on sharing features and the risks of exposing sensitive material to external platforms, even inadvertently.

ChatGPT is not your friend. It’s a database. In July 2025, Google indexed over 4,500 ChatGPT conversations containing sensitive personal information. Because users clicked “Share,” and the system created public URLs. Google crawled, indexed and shared them. Here’s what surfaced: 🔸 Mental illness, addiction, and abuse 🔸 Names, locations, emails, resumes 🔸 Medical histories, legal strategies All searchable, linkable and public until OpenAI intervened: ✔️ The “Discoverable” sharing feature was disabled on July 31. ✔️ They are working with Google and other search engines to remove indexed chats. ✔️ OpenAI reminded users: deleting a chat from history does not delete the public link. Millions of people, including employees and customers are confiding in AI. They believe it’s private and safe. But it isn’t. It’s recording. Indexing. Storing. And when systems designed for experimentation are used for confession, the boundaries between personal risk and enterprise liability vanish. What are the implications for Boards? 1️⃣ Regulatory risk Under GDPR: 🔹 Data subjects have the right to erase, access, and informed consent. 🔹 Shared AI conversations with personal or sensitive data may violate these rights. 🔹 AI-generated prompts could fall under automated decision-making clauses. Under the EU AI Act: 🔹 Transparency, risk classification, and human oversight are mandatory. 🔹 This incident may be classified as a high-risk system failure in healthcare, HR, legal. 2️⃣ Legal risk There is currently no legal confidentiality in AI interactions. ✔️ Anything entered into AI could be subpoenaed, discoverable in court or leaked. ✔️ Companies are liable if employees share PII, IP, or client data via chatbots. ✔️ HR, Legal, and Compliance teams must assume AI logs are discoverable records. 3️⃣ Reputational risk People assumed they were talking to a trusted tool. Instead, they ended up on Google. For enterprises using AI for: ▫️ Coaching or mental health ▫️ HR assistance ▫️ Legal or compliance advisory ▫️ Customer service … this is a trust risk. Public exposure = brand damage. 4️⃣ Operational risk Many organisations lack: 📌 AI input/output governance 📌 Policies for AI use in confidential workflows 📌 Deletion/audit protocols for AI-linked data Takeaway If employees or customers treat ChatGPT like a coach, or colleague, ensure to treat it like a legal and technical system. That means: ✅ Create AI use and data handling policies ✅ Restrict use of genAI in regulated or sensitive domains ✅ Review GDPR/AI Act exposure for all shared AI features ✅ Treat all AI interactions as auditable records ✅ Demand transparency from vendors: what is stored, shared, indexed? We just handed ChatGPT our most important asset. Every team discussion. Every big decision. Every private moment when someone explains the real story behind a choice. All of it now flows through OpenAI's servers. While we're celebrating the convenience of automated summaries, we're casually uploading our competitive advantages to a third-party platform. The patterns in how your team thinks, the unique methodologies you've developed, the proprietary frameworks that give you an edge, all becoming training data. Think about what gets discussed in your leadership meetings: market strategies, customer insights, roadmaps, hiring plans, partnership negotiations. The kind of intelligence that competitors would pay millions to access. I'm not saying don't use AI tools. I'm saying treat them like what they are: external consultants who remember everything and never signed an NDA. In the next year and a half, we'll see the first big corporate scandal. Someone will discover that "AI training data" exposed a company's private strategies. Some CEO will have to explain to Congress how their meeting notes showed up in a competitor's ChatGPT results. Be careful what you share with AI tools. Your private business information might not stay private.

We’re all leaning into AI—using it to streamline workflows, boost creativity, or yes, even draft that tricky email. But here’s a timely reminder from the WSJ: Just because AI feels like a safe space doesn’t mean it is one. 💡 When you enter info into a chatbot, you lose possession of it. That means anything personal, proprietary, or protected—think medical results, financials, company IP, or login credentials—can end up in a data breach, used to train future models, or flagged for human review. Yikes. Here are five things you should never share with AI tools: Your identity details (SSN, address, birthday) Health data (bloodwork, diagnoses) Bank or investment account numbers Confidential company info (client data, internal tools, source code) Logins and security questions 🧠 A good rule of thumb: if you wouldn’t say it out loud in a crowded coffee shop, don’t type it into a chatbot. For leaders rolling out AI internally—get serious about enterprise-grade security and internal training. Your team needs guardrails. For jobseekers using AI to polish your resume—go for it, just redact personal info and know how the tool handles your data. And for everyone else? → Use strong passwords → Delete conversations you don’t want stored → Try “temporary chat” or anonymous tools when in doubt AI is here to stay—but so is your digital footprint. You paid your lawyer $500 for a one-hour legal strategy session. Then you pasted it into ChatGPT to "understand it better." CONGRATS: opposing counsel can now subpoena that chat. This isn't hypothetical. In United States v. Heppner, a CEO pasted his lawyer's defense strategy into Claude AI. The FBI seized his devices and found all the chats. All 31 of them. And when he tried to claim privilege — the court shut it down. Reason: Attorney-client privilege only works when the conversation stays confidential. When you share it with a third party, that protection is gone. And AI platforms are third parties. ChatGPT, Claude, Gemini. These are companies with servers, data policies, terms of service. None of them owe you confidentiality. That's not a private conversation anymore. That's a record. And the other side can ask for it. I get it. AI feels private. Like a notes app. Like thinking out loud. But legally, it's not. And don't get me wrong. I'm not anti-AI. I run a law firm. We use it too. But instead of public AI, we use enterprise tools with safeguards that don't train on client data. If it's legal, strategic, or sensitive: DO NOT paste it into a chatbot. And if you're still in doubt, ask yourself: Would you hand this to opposing counsel? If the answer is no, don't hand it to ChatGPT either.

“Would you ever paste a client’s confidential email into ChatGPT and assume it’s safe?” I asked a solo lawyer this recently. Their response: “Sure, I’m on ChatGPT Pro. I thought that meant it was secure.” Here’s the reality: Why Pro and Team plans are not secure enough • No Business Associate Agreement (BAA), which HIPAA requires when tools handle protected health info. • No SOC 2 Type II certification, meaning no independent audit of data safeguards. • And critically, in NYT v. OpenAI the court issued an order requiring OpenAI to preserve all user chats . . . even if a user deletes them. That means there is no reasonable expectation of privacy. Anything you type into consumer ChatGPT can be subject to discovery. What Enterprise really provides • BAAs and SOC 2 Type II audits. • Contractual guarantees your data won’t be used for training. • Stronger safeguards for confidentiality compared to consumer-level tools. The problem for solos and small firms ChatGPT and Claude Enterprise start around $60/user/month with minimums of 70 - 150 seats. That’s not realistic for most small firms. The practical alternatives • Microsoft Copilot ($30/user/month with M365) → enterprise-grade protections, no seat minimums. • Google Gemini Enterprise ($20–30/user/month with Workspace) → HIPAA-ready, SOC 2 certified, and available even to single accounts. Why it matters That solo lawyer realized they’d been exposing client data without knowing it. It was a wake-up call , and one I see happening across the profession. ABA Opinion 512 and California’s guidance are clear: lawyers now have an ethical duty to understand and disclose their use of AI. That includes knowing whether your “secure” AI tool really is secure. And to be clear, I’m talking here about general-purpose LLMs. Legal-specific AI tools do exist that are purpose-built with BAAs, SOC 2, and HIPAA compliance in place. But if you’re using consumer versions of ChatGPT or Claude, that’s where the biggest risks lie. That’s why I created a Secure Vendor Vetting Checklist for small firms.
