The result? A consistent salary gap in AI-generated recommendations. No algorithm defines your worth - You do. This isn't just a technical error—it's algorithmic bias in action. These tools learn from historical data that reflects decades of pay inequity. And now they're perpetuating it at scale. What we can do: → Audit the AI tools we use in HR and talent management → Train teams to recognize and question biased outputs → Ensure compensation frameworks are based on role, skill, and impact—not gender → Advocate for transparency in algorithmic decision-making Technology should advance equity, not encode inequality. Using summaries, structured files, project overviews, and scoped retrieval beats dumping full files into the prompt window. 3. 𝗣𝗹𝗮𝗻𝗻𝗶𝗻𝗴 𝗶𝘀𝗻’𝘁 𝗼𝗽𝘁𝗶𝗼𝗻𝗮𝗹 ➜ You can’t expect an agent to solve multi-step problems without an explicit process. Patterns like plan > execute > review, tool use when stuck, or structured reflection are necessary. And they apply to all models, not just Claude. 4. 𝗥𝗲𝗮𝗹-𝘄𝗼𝗿𝗹𝗱 𝗮𝗴𝗲𝗻𝘁𝘀 𝗻𝗲𝗲𝗱 𝗿𝗲𝗮𝗹-𝘄𝗼𝗿𝗹𝗱 𝘁𝗼𝗼𝗹𝘀 ➜ Shell access. Git. APIs. Tool plugins. The agents that actually get things done use tools — not just language. Design your agents to execute, not just explain. 5. 𝗥𝗲𝗔𝗰𝘁 𝗮𝗻𝗱 𝗖𝗼𝗧 𝗮𝗿𝗲 𝘀𝘆𝘀𝘁𝗲𝗺 𝗽𝗮𝘁𝘁𝗲𝗿𝗻𝘀, 𝗻𝗼𝘁 𝗺𝗮𝗴𝗶𝗰 𝘁𝗿𝗶𝗰𝗸𝘀 ➜ Don’t just ask the model to “think step by step.” Build systems that enforce that structure: reasoning before action, planning before code, feedback before commits. 6. Right now, I’m watching a dangerous trend unfold. One that’s being marketed really well — and leading people down the wrong path. Someone builds a chatbot. They start a prompt course. And suddenly, they’re calling themselves an AI strategist. But building with AI isn’t the same as building strategy for AI. 💬 Because your organisation doesn’t need another shiny tool. It needs a system. A roadmap. A governance structure. A values-aligned, risk-aware, people-centered approach to transformation. That’s not something you get from a prompt template. The AI Act provisions on Prohibited AI systems look like they will apply before the end of the year. Many organisations think these won’t apply to them… I have set out some of the prohibitions and outlined some real-world use cases of those systems. 1. Manipulative/Deceptive AI The Act bans AI systems that use subliminal, manipulative, or deceptive techniques to significantly alter a person's behavior in ways that impair their ability to make informed decisions, leading to potentially significant harm. Eg: Digital advertising platforms using AI to send subliminal messages that exploit psychological vulnerabilities, coercing individuals into making decisions against their best interest, such as unnecessary purchases or unhealthy behaviors. 2. Exploiting Vulnerabilities It's prohibited to use AI to exploit the vulnerabilities of individuals or groups based on age, disability, or socio-economic status, resulting in material distortions of behavior that could cause significant harm. Eg: Personal finance AI applications targeting vulnerable elderly users with unsuitable investment advice, leveraging age-related vulnerabilities to influence financial decisions detrimentally. 3. Sensitive Biometric Categorisation The Act outlaws AI systems that categorise individuals based on biometric data to infer sensitive information, such as race or sexual orientation, barring law enforcement applications under strict conditions. Eg: AI-driven hiring platforms that use video interview analyses to infer protected characteristics, facilitating covert discriminatory practices by disqualifying candidates on these bases. 4. Social Scoring The legislation bans AI that evaluates or classifies people based on social behavior or inferred characteristics, leading to detrimental or unfair treatment unrelated to the context in which the data was collected. Eg: Corporate social credit systems monitoring employees' behavior beyond the workplace, affecting their opportunities or status based on non-work related activities or in disproportionate responses to their actions. 5. Untargeted Facial Recognition Databases The creation or expansion of facial recognition databases through untargeted scraping of internet or CCTV footage by AI systems is prohibited, addressing privacy and data protection concerns. Eg: Applications that build extensive facial recognition databases from online images or without consent, posing severe privacy infringements and unauthorised surveillance risks (btw - this has happened before). 6. Emotion Recognition Deploying AI to infer the emotions of individuals in workplaces and educational institutions is banned, except for medical or safety purposes, to protect against unwarranted emotional surveillance. Eg: Tools used by employers to monitor and analyse emotional states, allowing employers to weed out “undesirable” or “unenthusiastic” workers. It may be worth checking that these prohibitions don’t apply to you. Your call!

Know AI’s Capabilities and Limitations AI is not infallible. Understanding what AI can and cannot do, its risks, and how to mitigate inaccuracies is essential for responsible use. 2. Use AI Lawfully and Ethically Legal compliance and ethical considerations are paramount. AI must be deployed responsibly, with proper data protection, fairness, and risk assessments in place. 3. Ensure Security and Resilience AI systems are vulnerable to cyber threats. Safeguards like security testing and validation checks are necessary to mitigate risks such as data poisoning and adversarial attacks. 4. Maintain Meaningful Human Control AI should not operate unchecked. Human oversight must be embedded in critical decision-making processes to prevent harm and ensure accountability. 5. Work with Commercial Experts Collaboration with commercial and procurement teams ensures AI solutions align with regulatory and ethical standards, whether developed in-house or procured externally. 9. Develop AI Skills and Expertise Upskilling teams on AI’s technical and ethical dimensions is crucial. Decision-makers must understand AI’s impact on governance and strategy. 10. Align AI Use with Organisational Policies AI implementation should adhere to existing governance frameworks, with clear assurance and escalation processes in place. AI in healthcare can be revolutionary if it’s done right. My key (well some) takeaways: - Any AI solution aimed at the NHS must comply with UK AI regulations, GDPR, and NHS-specific security policies. - AI models should be explainable to clinicians and patients to build trust. - AI in healthcare must be clinically validated and continuously monitored. - Having internal AI ethics committees and compliance frameworks will be key to NHS adoption. Three major developments in the last week should have every HR leader, employer, and AI vendor paying attention: 1. The AI Civil Rights Act was reintroduced in the US Congress Led by Senator Ed Markey and Representative Yvette D. Clarke, this legislation places hard guardrails around AI and algorithmic systems used in decisions related to hiring, housing, healthcare and beyond. It demands transparency, bias testing, and accountability. Think of it as GDPR for bias, but with broader implications across HR, tech, and operations. “We will not allow AI to stand for Accelerating Injustice.” – Senator Ed Markey for U.S. Senate 2. California’s new workplace AI discrimination laws are now in effect. The new rule governing companies' use of automated decision-making technology will likely create a situation where companies are liable for hiring practices if a system violates anti-discrimination laws. As other U.S. states also implement laws and regulations containing similar ADMT protections, companies deploying the technology will need to be proactive in their record keeping and vetting of third-parties while auditing their own tools to understand how the software functions. It’s no longer enough to trust your tools and vendors, you must prove they’re fair. 3. Insurers are backing away from covering AI risks AIG, Great American, and WR Berkley are asking regulators to exclude AI-related liabilities from their policies. Why? Because the risks (from chatbots hallucinating to algorithmic bias in hiring) are seen as “too opaque, too unpredictable.” When insurers are pulling cover, it’s a warning sign: you own the risk. 👁 What this means for HR and recruitment business leaders: We’ve officially entered the age of AI Accountability. That means: ✅ You need visibility into how your AI systems work, especially if they’re used for hiring, performance management, or workforce planning. ✅ You must audit your HR tech stack (yes, that includes Workday, ATS platforms, and even AI resume screeners). ✅ You need to document fairness, not just assume it. ✅ You must rethink your contracts with AI vendors. The era of “train now, ask forgiveness later” is over. The U.S. Copyright Office just made it official: The use of copyrighted content in AI training is no longer legally ambiguous - it’s becoming a matter of policy, provenance, and compliance. This report won’t end the lawsuits. But it reframes the battlefield. What it means for LLM developers: • The fair use defense is narrowing: “Courts are likely to find against fair use where licensing markets exist.” • The human analogy is rejected: “The Office does not view ingestion of massive datasets by a machine as equivalent to human learning.” • Memorization matters: “If models reproduce expressive elements of copyrighted works, this may exceed fair use.” • Licensing isn’t optional: “Voluntary licensing is likely to play a critical role in the development of AI training practices.” What it means for enterprises: • Risk now lives in the stack: “Users may be liable if they deploy a model trained on infringing content, even if they didn’t train it.” • Trust will be technical: “Provenance and transparency mechanisms may help reduce legal uncertainty.” • Safe adoption depends on traceability: “The ability to verify the source of training materials may be essential for downstream use.” Here’s the bigger shift: → Yesterday: Bigger models, faster answers → Today: Trusted models, traceable provenance → Tomorrow: Compliant models, legally survivable outputs We are entering the age of AI due diligence. In the future, compliance won’t slow you down. It will be what allows you to stay in the race.
