    A few months ago, I was helping a fintech company prepare for DPDPA compliance. Their website looked modern — clean interface, great UX, everything polished. But their consent banner? Total chaos. It popped up with a cheerful line: “By using this website, you agree to our privacy policy.” That was it. No mention of the law, no clarity on what data was being collected, no easy way to withdraw consent later. It looked fine from a design perspective — but from a compliance and trust perspective, it was completely broken. This is what went wrong under GDPR too. Everyone had the freedom to make consent banners their own way — different colors, formats, and wording. The result? Confusion. People stopped reading, and consent became a routine click. The Digital Personal Data Protection Act (DPDPA) decided to take a smarter route. It didn’t copy GDPR — it learned from it. The BRD–CMS framework now gives Indian organizations a clear and practical playbook for consent — what to include, how to design, and how to actually make it user-friendly and compliant. Here’s how that fintech company rebuilt its consent notice — step by step 👇 1. Mention the law upfront. They started the notice with a simple line: “This notice is issued under the Digital Personal Data Protection Act, 2023.” That instantly changed the tone. It looked official, trustworthy, and transparent — not like another random pop-up trying to sell cookies. 2. Tell people who you are and why you need consent. Instead of generic text, we wrote: “FinFlow requests your consent to process your data for secure account creation and communication.” It’s short, plain, and honest — no fancy legal jargon. Users could finally understand why their data was needed. 3. Give control back to users. We added simple, visible buttons — Give Consent, Manage Consent, Withdraw Consent. Everything in one place. Because consent isn’t a checkbox — it’s a continuing choice. 4. Be upfront about what you collect. We listed it clearly: Name (for account creation) Email (for communication) Mobile number (for authentication) No vague “we may collect personal information” lines. Users appreciate straight talk — not fine print. 5. Match data with purpose. Each data field was mapped to a clear purpose. No more “we’ll use this to improve services” kind of blanket statements. If you collect it, say why. That’s how you earn trust. 6. Add expiry to consent. We set it for 365 days. After that, the user gets a reminder to re-consent. No indefinite “we’ll keep it forever” attitude. It’s clean, responsible, and user-centric. 7. Remind people of their rights. We added a short section — easy to read, no legal tone: “You can withdraw consent or request correction of your data anytime from your profile settings.” It showed the company respected user rights — not just compliance checkboxes. 8. Make it a real action. No pre-ticked boxes. No “By using this site, you agree…” tricks. Users had to choose.

    Meta’s recent Rs.213 crore penalty in India shines a harsh light on the issue of economics of consent. When access to Whatsapp became tied to expanded data sharing with Facebook, the Competition Commission called it what it was: "a lack of genuine choice". This moment marks as a turning point in the privacy landscape as DPDPA doesn’t just demand lawful consent - it demands meaningful consent. Consent that stands on autonomy, not coercion. Because “accept all or leave” is no longer an option. If you’re a platform handling millions of users or a privacy leader designing consent roadmap - here’s my top 3 recommendations to consider while building a new consent roadmap under India’s DPDPA: 1. Separate core service from data-sharing purposes - Users should be able to access your main service like messaging or social networking without being forced to agree to broad data-sharing across group entities. Structure your consent architecture around purpose and let users say yes to communication features and no to targeted ads, without losing access. 2. Audit your purposes to prove necessity - Not every data-sharing purpose is “necessary” for service delivery. If a purpose primarily serves advertising or analytics, put it as optional. Keep a documented rationale for each purpose. 3. Rethink monetisation - The so called “consent or pay” model (either share data or pay for access) risks creating economic pressure on privacy. If users must pay to refuse tracking, is that really free consent? Instead, explore value-based tiers like enhanced security, collaboration features, or storage instead of a fee for keeping one’s data private. The next era of privacy compliance will hinge on how purpose-based consent is operationalised. That means platforms can’t just fix their privacy notice. They need to rebuild their consent architecture - in UX design, backend logic, and commercial thinking.     🔐 Designing For Privacy UX. Privacy isn’t about hiding something, but protecting user’s personal space. UX guidelines on how to design more respectful, private experiences that drive long-term loyalty ↓ 🤔 When data requests feel intrusive, users enter fake data or give in. ✅ Privacy is about user’s control of what happens to their data. ✅ Privacy by default: features should work with min data required. 🚫 Don’t ask for permissions that you don’t need at the moment. ✅ Right to be forgotten → allow users to delete data in settings. ✅ Data portability → allow users to take their data with them. ✅ Hidden Unsub links downgrade email reach (marked as spam). ✅ Neutral choices → give people real choices with neutral defaults. ✅ Data you don't ask for is the data you can't lose in a breach. ✅ Explain then ask → if you need user’s data, first explain why. ✅ Try before commit → show and explain value before asking for data. ✅ Remind me later → give people time to make a decision on their terms. ✅ Contextual consent → ask for data only when user’s action needs it. ✅ Automated data decay → delete user's data not used after X months. --- In many companies, privacy is treated as a technical hurdle to be cleared off. Companies thrive on user’s data for personalization, customized offers, better AI models — but also invasive targeting, ultra-precise tracking, behavioral predictions and eventually reselling data to the highest bidder. All of it isn’t only invasive and undermines trust — it also makes for slow experiences and advertising following you everywhere you go. Predictive models know a person is pregnant based on their browsing habits before they do. And once they do, ads, offers and messages will follow you everywhere you go — before your closest relatives hear it from you. When we speak about privacy, we often assume that that’s an exaggerated problem that doesn’t really affect us much. After all, we have nothing to hide, and so there is no harm in companies knowing a few things about us. But privacy isn’t about hiding something. It’s about protecting your personal space from external influence and manipulation. It’s about protecting your personal decisions and your intimate experiences, and having a choice to share them with people you trust and care of. Most people wouldn’t feel comfortable being observed by a camera during their work or during their spare time. Yet as we move from one page to the next, that’s exactly what happens, often without our consent. And just like web performance and accessibility, privacy is a part of user's experience. The good news is that European Commission is looking into modifying the way GDPR works. So users could tick a box in browser preferences, with privacy settings turned on by default. And then websites shouldn't be allowed to ask for consent because it's already not granted. I'm looking forward to that future.
