    Struggling to build a data foundation that helps you deploy AI models at scale? Regulation can help. Too often in my professional life I have heard the old adage that regulation is a blocker to innovation. In my experience, what actually impedes on innovation is uncertainty; specifically when relevant rules are missing, unclear, or poorly aligned. No doubt this was true for both the GDPR and AI Act, at least in the beginning. What is often overlooked, however, is that these laws also provide notable benefits: among others, guiding organizations how to approach data-driven innovation in a structured and sensible way. ➡️ How GDPR supports data readiness Art. 5 GDPR requires, e.g., purpose limitation, data minimization, accuracy, integrity, confidentiality, and accountability. Organizations must decide which personal data they need, why, and who is responsible. This amounts not only to a responsible but also strategic approach to handling data - and not just personal data. ➡️ How the AI Act builds on this Art. 6 AI Act links an AI system’s obligations to its intended use and impact on people’s health, safety, and fundamental rights. Art. 10 then mandates data governance requirements for high-risk AI systems, e.g., that training, validation, and test datasets are relevant, representative, complete, and documented. Providers must implement measures covering provenance, cleaning, annotation, assumptions, gap analysis, bias detection, and ongoing monitoring. These rules offer a practical blueprint for AI-ready data. ➡️ Why this matters for AI strategy A strong data foundation improves model performance, but also reveals when AI is not the right tool. A rules-based system might achieve the same outcome with less risk and less complexity. The decision when not to use AI should be part of any good AI strategy too. ➡️ What organizations should do ✅ Define the purpose of processing: What are you trying to achieve? How does this improve the status quo? What tradeoffs do you need to consider? ✅ Use Art. 5 GDPR to decide what personal data you need to achieve your processing purpose in the least intrusive way. ✅ Evaluate whether you need AI - or if a rules-based system suffices. ✅ If you do need AI, leverage the AI Act’s Art. 6 intended use test and Art. 10 data governance rules as a readiness checklist. In particular, if it looks like you would be developing or deploying a high-risk AI system, make sure you have the necessary resources to do so. ✅ Create clear roles and responsibilities along the lifecycle of data processing to continuously ensure the quality, consistency, and reliability of data. ✅ Delete data when you no longer need it. This not only saves resources, but minimizes your compliance exposure. Too often, regulation is framed as a constraint.     Another great paper by Jonas Schuett, Senior Research Fellow at the Centre for the Governance of AI (GovAI) of AI, and co-authors has tackled a critical question: How specific should AI regulations be? Link to paper: https://lnkd.in/gNmpZiK3 Determining the appropriate level of specificity in AI regulations is relevant as more and more jurisdictions begin to regulate frontier AI systems, due to the risks stemming from AI and frontier models/generative AI (AI chatbots) in particular. The paper highlights significant risks from frontier AI systems, such as producing discriminatory outputs, creating deepfake pornography, spreading false narratives, and aiding cybercriminals. Future concerns include AI providing instructions for biological weapons, manipulating people in critical infrastructure, and autonomous agents replicating themselves and evading control. When addressing risks through regulation, the paper offers a framework to help decide how specific different requirements should be phrased and required in legislation, regulation, and voluntary standards. (see Table 3 below, p 33) There are 2 ends of the spectrum: - Specific rules such as "frontier AI systems must be evaluated for dangerous model capabilities following the protocol set forth in..." provide clear guidelines and are easier to enforce but can become quickly outdated. - On the other hand, high-level principles like "frontier AI systems should be safe and secure" offer adaptability and are more suitable when the best regulatory approach is uncertain, though they provide less certainty and are more costly to enforce. To navigate between those approaches, two sets of questions should be considered: 1.) how specific a requirement should be to avoid overly specific rules, 2.) allocating responsibility for specifying requirements between legislators, regulators, and standard-setting bodies. The paper recommends that policymakers should initially: 1. Require adherence to high-level principles for safe frontier AI development and deployment, while some requirements could already be formulated as rules. 2. Ensure close oversight by regulators and third parties on how developers comply with these principles. 3. Urgently build up regulatory capacity. It’s a blueprint for how to scale responsible AI at the system level across legal, infra, and dev. The deeper shift. Most AI governance efforts today live in docs, not systems. The EU AI Act flips that. You now need: • Templates that live in MLOps pipelines • Quality gates that align with Articles 8–27 • Observability for compliance reporting • Playbooks for fine-tuning or modifying GPAI models The whitepaper makes one thing clear: AI governance is moving from theory to infrastructure.     #ISO5339 provides high-level guidance for developing and applying AI systems by focusing on stakeholder roles, trustworthiness, risk management, and societal impacts. In contrast, #ISO5338 focuses on the technical processes involved in the AI system lifecycle, such as data engineering, model validation, and continuous monitoring. So how should you use ISO5339? Potential ISO5339 Use Cases: 1. Strategic AI Planning and Governance  When you are at the early stages of developing an AI application or integrating AI into your organization, you should use this standard to: - Identify stakeholder roles and responsibilities, including AI producers, users, and regulators. - Define non-functional characteristics such as trustworthiness, risk management, and ethics. - Facilitate multi-stakeholder communication and alignment by providing a high-level view of the AI application context and its lifecycle. 2. Establishing AI Governance Models  If you are building or refining your organization’s AI governance framework, you should ISO5339 to help: - Implement guidance on trustworthiness: including ethical considerations and risk management, which are essential for creating a solid governance structure. - Manage AI application lifecycle at a macro level, ensuring stakeholders understand their roles and responsibilities. - Incorporate societal and regulatory considerations, especially when your AI system impacts the broader public or operates in highly regulated environments. 3. Communicating AI Concepts to Non-Technical Stakeholders  When you need to engage with non-technical stakeholders such as executives, legal teams, or the community, you should reference this standard to: - Provide a high-level overview of AI application considerations, risks, and benefits in clear, accessible language. - Address societal impacts and ethical concerns, making it easier for non-technical stakeholders to understand the broader implications of AI. - Guide communication on how AI applications align with your organization's strategic and societal goals. 4. Regulatory and Policy Discussions  When you are interacting with regulators or policymakers, particularly in highly regulated sectors like healthcare or finance, ISO5339 will assist you to: - Align AI development with regulatory expectations and public policies focused on AI ethics and governance. - Justify decisions related to design and operations by emphasizing trustworthiness, risk management, and ethical concerns, which are key issues for regulatory bodies. 5. Establishing Trust and Transparency in AI Applications  If you are focused on building trust with customers, partners, or the public, use ISO5339 to: - Emphasize the trustworthiness of your AI applications through documented processes that ensure reliability, fairness, and transparency. - Implement ethical AI considerations to demonstrate that your AI applications are socially responsible and compliant with societal expectations and norms.     Are Regulators Ready for AI? A Shift in Governance Thinking ⚖️🤖 The UK AI Regulatory Capability Framework, developed by the Alan Turing Institute, signals a meaningful shift in how AI governance is being framed. Instead of concentrating on how organisations design and deploy AI, it turns the lens inward and asks a more fundamental question: 👉 Do regulators themselves have the capability to govern AI effectively? Rather than introducing new compliance duties for AI developers or users, the Framework acts as a capability maturity model for regulatory authorities. It identifies 28 regulatory activities spanning the full lifecycle — from horizon scanning and agenda-setting 🔍, to rulemaking and supervision 📜, and ultimately enforcement and evaluation 📊. These activities are assessed across six core capability dimensions, including: 🔹 Legal authority 🔹 Resources and funding 🔹 Technical infrastructure 🔹 Skills and expertise 🧠 🔹 Intelligence and data access 🔹 Institutional leadership and coordination A standout feature is the use of “what good looks like” capability statements. These provide regulators with a structured way to self-assess institutional readiness, moving AI governance away from high-level principles toward practical operability and maturity 🧭. This approach differs markedly from frameworks such as ISO/IEC 42001 and the NIST AI Risk Management Framework, which are aimed at organisations building or deploying AI systems. Those tools focus on internal controls and risk management — and largely assume that effective regulatory oversight is already in place. The same assumption appears in Japan’s AI Guidelines for Business, Singapore’s Model AI Governance Framework, and Australia’s AI Ethics Principles. While these frameworks articulate important norms, they do not address whether regulators have the statutory powers, technical capacity, data access, or coordination mechanisms required to enforce them in practice ⚙️. The UK Framework’s real contribution is its system-level perspective. It recognises that fragmented mandates, uneven expertise, limited information-sharing, or unclear authority can weaken even the strongest regulatory standards 🧩. For legal and policy professionals, this matters. As AI increasingly cuts across sectors and jurisdictions, effective oversight depends not only on rules, but on regulatory capability, coordination, and adaptability 🚦.
