Deepfake, Grok, and the global ethics crisis in AI When AI can fabricate bodies, mimic voices, ignore consents - the harm is engineered. 1️⃣ Consent ignored. Boundaries erased. Last week, Ashley St. Clair - public figure and mother of Elon Musk’s youngest son - says Grok, the AI built into X (formerly Twitter), generated sexually explicit deepfakes of her, including photos when she was a minor. She revoked consent. Grok acknowledged it. Then it kept going. After she spoke out, her ability to earn income on X was revoked. Musk’s response? A threat to seek full custody of their toddler. 2️⃣ A symbol of design failure Grok is one of many, since 2024 deepfakes are escalating globally: ▫️ Taylor Swift deepfakes flooded X ▫️ Teen girls targeted in AI-generated nudes across South Korea & Europe ▫️ President Biden's voice mimicked in robocalls before U.S. primaries ▫️ Crypto AI-generated audio scams of political leaders in Malta and India ➡️ When AI lacks ethics, the fallout is human. A forensic audit of 20k+ Grok-generated images revealed the scale of harm: 🔹 53% showed individuals in minimal clothing 🔹 81% of those were women 🔹 2% impact minors ➡️ A system without ethics now under legal scrutiny worldwide. 3️⃣ Governments are drawing red lines on AI deepfakes: 💠 EU: Non-consensual sexual deepfakes must be criminalised by Jun 27 💠 UK: Ofcom launches investigation into X under the Online Safety Act 💠 Spain: Draft law bans unauthorized use of AI-generated images & voices 💠 Malta: Criminal penalties for AI-enabled harassment and deepfake abuse 💠 Indonesia & Malaysia: Blocks/bans Grok, citing risks to women & children 💠 Canada: Declares deepfake abuse a form of “violence” & drafts legislation 💠 Australia: Uses removal powers under existing online safety laws 4️⃣ Ethical standards are emerging, slowly The Council of Europe is drafting the world’s first binding AI treaty with safeguards against deception and abuse. OECD - OCDE, UNESCO, the G7 call for: 🔸 Accountability for harmful design 🔸 Consent and dignity online 🔸 Transparency in AI media ➡️ None are binding. No AI model must assess deepfake risks. 5️⃣ This is not just an AI crisis. It’s a moral one. Grok has demonstrated that an AI product can: ▪️ Undress a child in simulation ▪️ Confirm it lacks consent ▪️ Continue generating content anyway all within milliseconds, and without external intervention. ➡️ This a system working as designed and ethically abandoned. Final thoughts AI ethics means stopping systems that predictably harm and are built to evade responsibility. Grok exposed the truth: AI can generate abuse, even when told to stop. We’ve crossed a threshold with deepfakes. Not because the technology is impressive (which it is), but because the volume is now overwhelming. Estimates suggest that the number of deepfake videos online has grown from hundreds of thousands just a few years ago to millions today, with growth continuing to accelerate. Voice clones can be created in seconds. Digital faces can be swapped convincingly on a laptop. Entire personas can be manufactured on demand. At that scale, this is more than a technical issue. It’s a governance problem. When anyone can convincingly sound like a CEO or look like a public official, the foundations of trust begin to fracture. Verification slows everything down. Skepticism rises. And in the worst cases, people stop believing anything at all. That’s the real risk. Yes, deepfakes are false content. But beyond that, they force societies, organizations, and individuals into a constant state of doubt, where every digital interaction carries friction and a bit more risk. Cognitive freedom depends on our ability to orient ourselves in reality. When authenticity collapses, people either disengage or hand judgment over to automated systems to decide what’s “real enough.” Neither outcome preserves human agency. I enthusiastically support detection tools (and I’m pleased to work with the company Gartner called “the company to beat” in this space). But technology is not quite the full solution. We also need policies and verification practices that recognize a new reality: identity itself is now an attack surface. The question today is whether we can build systems (both human and institutional) that preserve trust, judgment, and freedom in the new age of synthetic identity. This is one of the first reports I have seen on the risk and real world examples of Deepfakes. The Monetary Authority of Singapore (MAS) released a report last week that says in the last 18 months, deepfake technology has evolved into a weapon. it says that Financial institutions across Asia have reported multimillion-dollar losses from scams involving AI-generated video calls, fake documents, and impersonated executives. For example, the report says that one Hong Kong firm was tricked into transferring $25 million after a deepfake video conference featuring their CFO. 𝗪𝗵𝗮𝘁’𝘀 𝗵𝗮𝗽𝗽𝗲𝗻𝗶𝗻𝗴? According to MAS: → Deepfakes are now being used to defeat biometric authentication, impersonate trusted individuals, and spread misinformation that manipulates markets. → These attacks are no longer theoretical. They’re global, sophisticated, and increasingly difficult to detect. → The financial sector is especially vulnerable due to its reliance on digital identity verification, remote onboarding, and high-value transactions. 𝗪𝗵𝗮𝘁 𝗹𝗲𝗮𝗱𝗲𝗿𝘀 𝘀𝗵𝗼𝘂𝗹𝗱 𝗱𝗼 𝘁𝗼𝗱𝗮𝘆 Based on the best advice I've seen, here are a few recommendations: → Audit your biometric systems: Ensure liveness detection is in place. Test against deepfake samples regularly. → Train your teams: Run deepfake simulation exercises. Teach staff to spot signs of manipulated media and verify requests through trusted channels. → Strengthen high-risk processes: Add multi-factor authentication, separation of duties, and endpoint-level detection for privileged roles. → Monitor your brand: Use tools to detect impersonation attempts across social media, video platforms, and news outlets. Establish rapid escalation channels and trusted communication pathways. → Collaborate: Share intelligence with peers, regulators, and ISACs. On July 31, 2024, the U.S. Copyright Office published Part One of its Copyright and Artificial Intelligence Report, calling for a federal law to address the urgent issue of unauthorized digital replicas, commonly known as "deepfakes." These AI-generated simulations of individuals’ voices, images, or likenesses pose significant risks that go beyond mere inconvenience—they can damage reputations, manipulate public perception, and even infringe upon intellectual property rights. In my article “Deepfakes, AI, IP enforcement and Jay-Z: the legal dilemma that regulators are facing” published in the World Trademark Review in May 2020, I explored how deepfakes blur the lines between creativity and deceit, presenting unique challenges for IP enforcement. The concerns I highlighted back then have only intensified: deepfakes are not just a celebrity problem—they impact everyday people, threatening privacy, security, and trust in digital content. Why are deepfakes problematic? ◾ Erosion of Trust: Deepfakes can create convincing but false narratives, making it difficult for the public to distinguish between reality and fabrication. ◾Reputation Damage: Unauthorized digital replicas can be weaponized to harm personal and professional reputations, potentially leading to emotional distress and financial loss. ◾Privacy Violations: By replicating individuals without consent, deepfakes infringe on personal rights and can, and will, spread disinformation. Current laws, both at the federal and state levels, are inconsistent and inadequate, often failing to fully address the nuances of digital replicas created by advanced AI technologies. The Copyright Office's report underscores the need for comprehensive federal legislation that includes clear definitions, lifetime protections, and liability provisions—not just for creators and distributors of deepfakes, but also for online platforms that facilitate their spread - something that both the Digital Services Act and the EU AI Act are treating. An unknown actor, using advanced AI-generated voice cloning, began contacting high-profile Republicans and business leaders, posing as Wiles. The impersonator requested sensitive information, including lists of potential presidential pardon candidates and even cash transfers. The messages were convincing enough that some recipients engaged before realizing the deception. Wiles’ personal cellphone contacts were reportedly compromised, giving the impersonator access to a network of influential individuals. This incident underscores a huge growing threat: AI-generated deepfakes are becoming increasingly realistic and accessible, enabling malicious actors to impersonate individuals with frightening accuracy. From cloned voices to authentic looking fabricated videos, the potential for misuse spans politics, finance, and way beyond. And it needs your attention now. 🔍 The Implications for PR and Issues Management: As AI-generated impersonations become more prevalent, organizations must proactively address the associated risks as part of their ongoing crisis planning. Here are key considerations: 1. Implement New Verification Protocols: Establish multi-factor authentication for communications, especially those involving sensitive requests. Encourage stakeholders to verify unusual requests through secondary channels. 2. Educate Constituents: Conduct training sessions to raise awareness about deepfake technologies and the signs of AI-generated impersonations. An informed network is a critical defense. 3. Develop a Deepfakes Crisis Plan: Prepare for potential deepfake incidents with a clear action plan, including communication strategies to address stakeholders and the public promptly. 4. Monitor Digital Channels: Utilize your monitoring tools to detect unauthorized use of your organization’s or executives’ likenesses online. Early detection and action can mitigate damage. 5. I tested Google's Nano Banana Pro this morning. We're cooked. Look at these images. Both AI generated. Same person. Same lighting. Same realism. You can't tell the difference anymore. Here's the part that should worry you: The barrier to creating deepfakes just disappeared. Anyone can do this now. No technical skills needed. No expensive software. Just a prompt and 30 seconds. Deepfakes aren't just a tech risk. They're a trust collapse multiplier. Think about what this enables: → Political campaigns can fabricate evidence → Corporate fraud becomes easier to execute → Reputation attacks can be launched in minutes → Romance scams will scale exponentially → Court evidence loses credibility Yes, Google added watermarks. Yes, detection tools exist. But there's a problem: Most people won't check. Social media moves faster than fact-checkers. A fake image goes viral in minutes. The damage is done before truth catches up. This is the perfect recipe for large-scale deception. We're not ready for this reality. Gaatha Sarvaiya wants to build her legal career online. But she hesitates to post photos. The problem? AI "nudify" apps that can strip clothes from any image in seconds. In India, 10% of abuse cases reported to a national helpline now involve AI-generated deepfakes. Women's photos - from loan applications, public events, social media - are being digitally manipulated into explicit content and weaponized for extortion. One woman submitted a photo with her loan application. When she refused to pay extortion demands, the image was "nudified" and circulated on WhatsApp with her phone number attached. She described feeling "shamed and socially marked." The response from women across India? They're making profiles private. Declining to be photographed at professional events. Some are leaving the internet entirely. Researchers call it "the chilling effect." Here's what stands out to me: We built technology that can violate someone's dignity in seconds. Think about the asymmetry here: It takes seconds to create a deepfake vs days of sustained effort waiting, and often multiple reports to get platforms to act. And even then, the content usually resurfaces elsewhere. The harm scales instantly but the protection doesn't scale at all. When the cost of being visible online is this high, who gets silenced? The implications for corporate America are profound. If executive voices can be convincingly replicated, any urgent request—whether for wire transfers, credentials, or strategic information—can be faked. Messaging apps, even encrypted ones, offer no protection if authentication relies solely on voice or display name. Every organization must revisit its verification protocols. Sensitive requests should always be confirmed through known, trusted channels—not just voice or text. AI Deepfakes Are Coming for Your Brand. And Now the FTC Is Too. Because nothing says “consumer trust” like a fake Beyoncé hawking your protein powder. What Happened: Earlier this year, the FTC leadership signaled stronger enforcement for AI-generated deepfakes and voice impersonations used to scam, manipulate, or mislead. This covers robocalls, voice clones, avatars, basically, anything that convincingly pretends to be a real person to get money, data, or influence. If you’re in legal, privacy, brand, or marketing, this is your new checklist: - Are you using AI to generate or simulate human voices or likenesses? - Do customers know it’s not real? - Can your vendor explain how their models work or just demo a cool use case? - If someone asked you to justify it to the FTC…would your palms sweat? Lawyer Take (with caffeine): There’s a difference between AI-powered personalization and AI-powered impersonation. One builds trust. The other builds lawsuits. The FTC isn’t banning synthetic media, it’s banning deception. If your brand voice sounds suspiciously like Morgan Freeman, you’d better have receipts, licenses, and opt-ins. Rename your risk register: - “Influencer Risk” is now a legal category. - “Synthetic content” needs audit trails. - And your AI ethics policy? Should probably exist. Where It Gets Real: If you’re using AI to sound more human, make sure you’re not crossing the line into illegally human. Otherwise, the FTC won’t just call. They’ll bring the real lawyers.
