    Can your AI system explain why it rejected benefits claims? If not, it's not going into production. Multiple central government departments are now requiring new AI systems, especially those used in decision making like benefit fraud detection. This is being done to pass a formal AI Explainability gate before production rollout. This elevates technical risk and transparency from a compliance checklist to a crucial delivery step. The change responds to both the EU AI Act's ripple effects and local GenAI pilot failures that exposed the risks of deploying black box systems in public facing services. This is the governance maturity the sector needs. Building AI systems is straightforward. Explaining how they reach decisions is significantly harder. The timing matters. Too many pilots have failed not because the technology didn't work, but because nobody could justify the decisions it made. What this means for delivery: → Explainability must be designed in from day one → Technical teams need to document decision logic in plain language for non-technical colleagues → Procurement specifications must now include explainability requirements upfront The departments getting this right are treating explainability as a core architectural requirement, not a final compliance hurdle. This gate will slow some projects initially. But it prevents the far costlier problem of deploying AI systems that make decisions nobody can defend.     A regulator asked a bank to explain its AI agent's last 100 decisions. The bank showed them a confidence score. The regulator shut it down. This is happening more than anyone admits. "Explainable AI" has become the most misleading phrase in enterprise software. Every vendor checks that box. Almost none of them can produce what a regulator actually needs: Which rule fired. What data was examined. What the agent decided. Why. With evidence. For every single action. Not "the model was 92% confident." That tells a regulator nothing. They want to see: "Section 3.1(a) requires site verification for draws over $250K. The inspection report was dated Feb 15. The draw was $420K. Verification was confirmed within the 30-day window. Approved." That's the difference between a confidence score and an evidence chain. I've started calling this the Why-Trail. Not because it's clever, but because "explainability" has been diluted to the point where it means nothing. A Why-Trail is deterministic. It traces the exact policy, the exact data, and the exact logic path. It's reproducible. You can hand it to an auditor and they can follow it like a receipt. The EU AI Act hits full enforcement August 2, 2026. Article 14 mandates human oversight for every high-risk AI system. Credit scoring, loan approvals, insurance underwriting: all classified high-risk. 81% of leaders say human-in-the-loop is essential. Only 20% have mature governance to support it. That gap is where the next wave of regulatory enforcement will land. Here's the test: if your AI agent made a decision five minutes ago, could you pull up the full reasoning chain right now? Not a summary. Not a probability. The actual rule, the actual data, the actual logic. If you can't, you don't have explainability. You have a marketing page that says you do.     You’re hired as a GRC Analyst at a fast-growing fintech company that just integrated AI-powered fraud detection. The AI flags transactions as “suspicious,” but customers start complaining that their accounts are being unfairly locked. Regulators begin investigating for potential bias and unfair decision-making. How you would tackle this? 1. Assess AI Bias Risks • Start by reviewing how the AI model makes decisions. Does it disproportionately flag certain demographics or behaviors? • Check historical false positive rates—how often has the AI mistakenly flagged legitimate transactions? • Work with data science teams to audit the training data. Was it diverse and representative, or could it have inherited biases? 2. Ensure Compliance with Regulations • Look at GDPR, CPRA, and the EU AI Act—these all have requirements for fairness, transparency, and explainability in AI models. • Review internal policies to see if the company already has AI ethics guidelines in place. If not, this may be a gap that needs urgent attention. • Prepare for potential regulatory inquiries by documenting how decisions are made and if customers were given clear explanations when their transactions were flagged. 3. Improve AI Transparency & Governance • Require “explainability” features—customers should be able to understand why their transaction was flagged. • Implement human-in-the-loop review for high-risk decisions to prevent automatic account freezes. • Set up regular fairness audits on the AI system to monitor its impact and make necessary adjustments.     🛑AI Explainability Is Not Optional: How ISO42001 and ISO23053 Help Organizations Get It Right🛑 We see AI making more decisions that affect people’s lives: who gets hired, who qualifies for a loan, who gets access to healthcare. When those decisions can’t be explained, our trust erodes, and risk escalates. For your AI System(s), explainability isn’t a nice-to-have. It has become an operational and regulatory requirement. Organizations struggle with this because AI models, especially deep learning, operate in ways that aren’t always easy to interpret. Regardless, the business risks are real and regulators are starting to mandate transparency, and customers and stakeholders expect it. If an AI system denies a loan or approves one person over another for a job, there must be a way to explain why. ➡️ISO42001: Governance for AI Explainability #ISO42001 provides a structured approach for organizations to ensure AI decisions can be traced, explained, and reviewed.     Dear AI Auditors, Explainability as Audit Evidence One of the biggest challenges in AI audit is dealing with systems that behave like a “black box.” If auditors, management, or regulators can’t explain why a model produces certain outputs, assurance loses credibility. Explainability is not a “nice to have.” It’s a form of audit evidence. Without it, risk assessments remain incomplete, and accountability cannot be enforced. How to treat explainability as core evidence: 📌 Define the Level of Explanation Required Not all stakeholders require the same level of detail. Executives may only require high-level logic, while auditors need traceable technical reasoning. Align explanations with the audience and use case. 📌 Look for Documentation Standards Check whether the organization maintains model cards, fact sheets, or structured explanations of model purpose, inputs, and limitations. These artifacts serve as reliable evidence. 📌 Assess the Tools Used for Interpretability Techniques like SHAP values, LIME, or attention maps provide insights into how models weigh features. Confirm whether such tools are being used consistently and appropriately. 📌 Test Repeatability of Explanations An explanation that works once but not consistently is weak evidence. Verify that interpretability methods produce stable results under repeated audit tests. 📌 Check Accessibility of Explanations If only data scientists can understand the model, transparency is incomplete. Explanations should be written in language that management, regulators, and customers can digest. 📌 Verify Links to Decisions and Outcomes Explanations should not be abstract. They should directly connect model reasoning to specific business outcomes or customer impacts. 📌 Evaluate Governance Over Explanability Practices Who owns responsibility for explainability in the organization? Is there a policy or framework in place, or is it left to individual teams? When explanations are documented, consistent, and accessible, they become defensible audit evidence. Regulators are increasingly focusing on explainability as part of AI accountability. Organizations that fail here risk penalties, reputational damage, and stakeholder mistrust. Explainability closes the gap between technical complexity and organizational accountability.     Last Friday, I joined Laura Frederick and Nathan Leong for a timely How to Contract AI Explained session on Human-in-the-Loop and Transparency in AI contracts. Highlighting some of our discussion points: 1. Regulations Are Prescriptive and (for now) Focused on High-Risk Systems. HITL and transparency aren't just best practices, they are (in certain scenarios) legally mandated. The EU AI Act requires that high-risk systems provide meaningful human oversight built into the system. The Colorado AI Act requires that for consequential decisions there must be a "reasonable opportunity" for human review. GDPR Article 22 addresses when human intervention is required. The rules are specific for requirements in these areas, but we still have to translate that language to contractual terms. 2. Use a Risk-Tiered Framework. Even if you aren't deploying a high-risk system, you should think about how and where humans will be involved. Consider a tiered system based on risk that includes human review for high-risk and human intervention (override) for less risky. 3. Human Oversight Requires Real Resources. Under EU AI Act Article 14, overseers need "appropriate competence, training, and authority." Instead of general compliance with the laws language, your contracts should be clear about who provides reviewers, their qualifications, training costs, and what happens when review capacity hits a bottleneck. 4. Different Regulators Want Different Types of Transparency or Explainability. EU wants system-level architecture. GDPR wants "logic involved." Colorado wants decision-level reasons. NYC wants input factors disclosed upfront. Be specific about which type your use case requires. 5. Negotiate Customer Control Rights. Consider when and where you want operational flexibility (from the vendor and buyer side) to between operating / review modes, override decisions without penalty, and adjust confidence thresholds. Given resources and costs, vendors may consider tiered pricing reflecting different human involvement levels. My main takeaway: Human oversight and transparency should improve decision quality, not just provide someone to blame when algorithms fail. When we think about these issues, we should consider how they make our processes and decision-making more effective, not just how they shift liability.

    Explainability is not a feature you add to AI. It is what intelligence is. Without explainability, AI is just artificial gut feeling. We talk a lot about AI governance these days. But governance presupposes something governable. You can’t govern gut feelings. You can’t audit intuitions. You certainly can’t hold a latent space accountable. I’ve seen this play out repeatedly in real systems, under real scrutiny, especially where decisions have to be defended months or years later. When “understanding” is defined purely as functional success or predictive performance, governance quietly collapses into after-the-fact damage control. That isn’t governance, it’s risk management around opacity. Real governance, and real trust, require reasons: what a system assumed, what it inferred, why it chose, and how it would revise that belief. That is what explainability actually means, not a story generated after the fact, but explicit structure that can be questioned, challenged, and revised as conditions change and evidence accumulates. Trust does not come from confidence or performance. It comes from the ability to ask “why,” and get an answer that can be examined and changed. In regulatory and fiduciary environments, “sounding right” is a liability. Only traceable, explainable reasonings survive audits. A system we cannot interrogate about its beliefs is not intelligent. It is persuasive. Models will get better, demos will get flashier, failures will get louder. I’ll be expanding on this in a more detailed article shortly. #AI
