Insurance frauds in India are rampant—draining billions annually (health insurance alone loses an estimated ₹8,000–10,000 crore to fraud, waste, and abuse, with fraud impacting up to 15% of claims in some segments)—yet they are often not taken seriously enough by society, regulators, law enforcement, and the courts. Key reasons why insurance fraud remains under-prioritized, particularly by police and investigating agencies: 1. No Dedicated Legislation
India lacks a standalone law specifically targeting insurance fraud. Cases rely on general provisions of the Bharatiya Nyaya Sanhita making it tough to prove insurance-specific intent and secure strong convictions. 2. Low Conviction Rates & Endless Delays
Proving fraud requires complex evidence. Overburdened courts lead to years-long trials, often ending in minor fines rather than jail time—offering little real deterrence. 3. Lowest Priority for Police & Investigating Agencies
Police treat insurance fraud as a low-priority white-collar crime—seen as “victimless” since it mainly hits big insurers, not individuals. Unlike violent crimes or high-profile scams that spark public outrage and media pressure, these cases rarely get urgent attention. Overloaded forces focus on visible, high-impact crimes, sidelining complex financial probes that demand specialized skills, forensics, and inter-agency effort. Many fraud reports aren’t even pursued aggressively unless they involve murder-for-claims or massive organized rackets. 4. “Corporate Problem” Perception
Fraud is often viewed as an insurer’s internal headache, not a societal crisis. Low public outrage and limited media focus mean little pressure on police to act. Insurers themselves historically hesitate to push hard prosecutions due to court hassles, costs, and potential customer backlash from delays. 5. Enforcement & Systemic Gaps
Poor coordination between insurers, police, and regulators leads to delayed or diluted complaints. Officers often lack training in financial fraud detection, and resource shortages further deprioritize these cases—especially in rural areas where many schemes flourish. High-profile busts (like recent murder-linked scams in Uttar Pradesh or massive fake-claim rackets) prove action is possible when momentum builds. The new IRDAI framework—pushing AI analytics, data sharing via the Insurance Information Bureau, and compulsory law enforcement referrals—could help elevate priorities. But true change needs dedicated economic offense units, faster prosecutions, stricter penalties, and public campaigns to treat insurance fraud as seriously as other financial crimes. Until then, honest policyholders bear the cost through rising premiums, while fraudsters face minimal risk.
