Perplexity AI has taken a novel approach to dismissing claims of direct copyright infringement, specific to their December 2025 suit with the New York Times and Chicago Tribune: "Most AI defendants have leaned heavily on fair use. Perplexity's lawyers chose a different potential shield. They argue in their brief... that Perplexity did not 'make' the allegedly infringing copies in a legally relevant sense and therefore engaged in no 'volitional conduct' ​sufficient to support a claim of direct infringement... In simplified terms, the theory is that a user enters a query, the system automatically executes the request, but nobody at Perplexity consciously decides to copy the Times' article in that moment." Submitting a comic to a publisher raises the question of how to protect your ideas and characters. Securing copyright protection before submission proves more effective than relying on NDAs. Most comic book publishers won't sign NDAs and might reject unsolicited pitches to avoid accusations of idea theft. Registering the copyright early and understanding the submission agreement are key. This agreement acknowledges that similar ideas may arise independently, protecting publishers from liability. Prioritize copyright registration and monitor releases in your genre. 291 pages into the "One Big Beautiful Bill," Section 43201(c) creates a federal moratorium preventing states from enforcing any AI regulation - including existing laws on #deepfakes, nonconsensual imagery, and consumer protection. 40 out of 50 state Attorneys General and 140+ organizations opposed this provision. It affects hundreds of existing state laws, not to mention opening the floodgates for major market players to exploit the data they already have. Every day, we are seeing federal policy systematically dismantle the regulatory frameworks that smart, thoughtful people have spent years building. States like California, Colorado, and others have pioneered ethical AI oversight. This bill would eliminate that progress and replace it with nothing. The broader pattern is concerning: from gutting diplomatic expertise at State/USAID to imposing impossible work requirements on food assistance recipients, we're witnessing the deliberate dismantling of institutional knowledge and social infrastructure. For those of us in tech policy, our professional expertise increasingly feels irrelevant when evidence-based governance is abandoned. The burnout is real when you see carefully constructed regulatory frameworks and support systems—pesky things like human rights, civil rights, environmental regulations protecting consumers, healthcare and research funding, I can go on—destroyed overnight. This isn't "political:" it's about whether expertise, institutional knowledge, and evidence-based policy still matter in America. Plaintiffs have filed their supplemental brief in support of the proposed class settlement in Bartz v. Anthropic, defending the role of publishers' and authors' professional organizations in crafting and managing the distribution process. The preliminary approval hearing is set for this Friday, September 25, at 1 pm in Judge Alsup's courtroom.
