Over the past decade, I’ve spent much of my professional life advocating for reasonable access to nicotine vape products. Early on, the focus was on ensuring adult smokers had access to safer alternatives. But as regulations tightened and adoption grew, I witnessed the rise of an illicit market which continues to undermine public health and consumer safety. My advocacy soon shifted toward urging governments to take action against illicit sellers and supply chains. Unfortunately, provincial adoption of the harmonized excise tax, and subsequent increases, only made the problem worse. At the same time, the cannabis industry was facing many of the same challenges. The difference is that through controlled distribution and stricter oversight, both government and industry have begun making progress in tackling illicit cannabis sales, even though the problem is far from solved. In the midst of these shifts, the first nicotine pouch was authorized in Canada. Shortly after, then Health Minister Mark Holland mandated that nicotine pouches and any future novel nicotine NRTs could only be sold in pharmacies. While I disagree with keeping these products behind the pharmacy counter, restricting sales to pharmacies was the right decision. It created a safe supply chain, allowed qualified professionals to provide quit-smoking counselling, and offered a clear pathway for enforcement. Unfortunately, enforcement capacity never followed. Years of budget cuts left bureaucracies and regulators unable to properly monitor or enforce these rules. The result is that, years later, illicit nicotine and cannabis products remain widely available, even in small communities like mine in Beamsville. As a father of four, it’s frustrating and concerning to see “controlled” substances so easily accessed by youth through questionable sellers. Canada has developed regulatory frameworks designed to protect society, but frameworks without enforcement are hollow. If we truly want to protect public health and ensure responsible access, we need real investment in enforcement to disrupt illicit supply chains and tighter, smarter controls on the distribution of all controlled substances. Good regulation creates systems that work in practice. Limiting sales channels creates clearer enforcement paths and reduces the resources required to enforce them effectively, while sufficient penalties ensure enforcement action is meaningful.

An example of how California pursues fraud cases in health care ⤵️ 🏥 The Case: California v. Sweetwater Care On June 24, 2025, California Attorney General Rob Bonta filed a lawsuit against Sweetwater Care, a San Diego-based operator of 19 skilled nursing facilities. The allegations: ⚠️ 14,126 instances of staffing below California's minimum legal requirements (2020-2024) 💰 $31 million extracted as "profit" or "management fees" instead of funding legally required staffing 💵 $299 million received in Medi-Cal and Medicare payments during the examination period The patient harm documented in the complaint: ➡️Fractured bones that went days without assessment or medical care ➡️Patients with head trauma leaving facilities unbeknownst to staff ➡️Pressure injuries so severe a patient's hip bone was visible ➡️Medical emergencies not timely assessed or responded to ➡️Patients left overnight in soiled diapers because staff were too few 🎤 What the Attorney General Said "Sweetwater and its skilled nursing facilities violated the law and betrayed the trust of communities by failing to safeguard the health and safety of its residents. This is simply unacceptable." "We are holding Sweetwater accountable for breaking the law by understaffing its facilities and leaving residents vulnerable to serious neglect and injuries. No one is above the law, and our vulnerable patients deserve nothing less than dignity, safety, and high-quality care." 💡 The Funding Question Here's what makes this case instructive for the broader enforcement landscape: The investigation was conducted by California's Division of Medi-Cal Fraud and Elder Abuse (DMFEA). From the press release: "The Division of Medi-Cal Fraud and Elder Abuse receives 75 percent of its funding from the U.S. Department of Health and Human Services under a grant award totaling $69,244,976 for Federal fiscal year (FY) 2025. The remaining 25 percent is funded by the State of California." 🔄 Federal dollars funding state enforcement of facilities receiving federal program payments. This is one of the reasons people are so riled up from an enforcement perspective. Funding is federal. Accountability is state.
