Did you know irrevocable trusts are often seen as the ultimate shield in estate planning—but their protection depends heavily on how they’re structured? By definition, an irrevocable trust cannot be altered or revoked once it’s established, meaning the grantor gives up control of the assets placed inside. This separation can offer strong protection from creditors, lawsuits, and even estate taxes—but only under the right conditions. For example, if you retain too much control or name yourself as a beneficiary, a court may still consider those assets accessible. Additionally, while irrevocable trusts can help you qualify for Medicaid by removing assets from your estate, they must be created and funded well in advance—typically five years before applying. And while these trusts are powerful tools for protecting wealth and ensuring privacy, they come with trade-offs: inflexibility, complexity, and potential tax implications. Late 2025 was a sprint for CPAs, estate planning attorneys, and financial advisors. 🏃‍♂️ High-earning clients rushed to maximize charitable deductions before new limits, including a 0.5% floor and 35% cap, took effect on January 1, 2026.
