New FDA Draft Guidance - QMSR & Premarket Submissions The FDA just issued an important Draft Guidance Document "Quality Management System Information for Certain Premarket Submission Reviews" This guidance directly addresses the expectations for Quality Management System Regulation (QMSR) requirements in premarket submissions once the final rule amending 21 CFR Part 820 takes effect. What You Need to Know: The guidance focuses on the updated medical device Current Good Manufacturing Practice (CGMP) requirements, which align more closely with ISO 13485:2016 by incorporating the international standard by reference. When finalized, this guidance will assist manufacturers in preparing and maintaining the Quality Management System (QMS) and other required information for premarket submissions. This is a crucial document for regulatory, quality, and R&D teams, as it details how the FDA will review QMS information in applications going forward. The FDA is providing this draft for advance notice, and a notice of availability will be published in the Federal Register after the current lapse in appropriations ends, detailing how to submit comments. 🚨 Most CAPAs don’t fail from missing systems. They fail because thinking stops too soon. Regulatory inspections show 30–40% of CAPAs are incomplete, superficial, or ineffective. Too often we see: • “Retrain the operator” as the only root cause • Symptoms fixed, systems untouched • No evidence the action worked • Weak or missing oversight — A CAPA isn’t paperwork. It’s proof your organization can learn under pressure. Think of CAPA as a body: • Head — Clear problem definition • Brain — Root cause, not assumptions • Eyes — Management oversight • Heart — Effectiveness checks • Hands+feet — Corrective and preventive actions • Spine — Closure with systemic learning When one organ fails, the whole system suffers. — Regulators say it differently, but want the same thing: • FDA — rigor and system-wide impact • EMA — risk-based prevention • PMDA — detail and visible accountability Different accents. 🔍 A must-read from the FDA - and a timely reminder for all of us in Quality. So many CAPA systems look compliant, yet fail to drive real learning or prevention. The FDA highlights the quiet gaps that separate true quality maturity from teams simply “running the process.” Key message: ✔️ CAPA is a risk-based escalation, not a catch-all. ✔️ RCA must be protected from pressure and politics. ✔️ “Human error” is rarely the real root cause. ✔️ Forms should drive structured, evidence-based thinking. ✔️ Trending isn’t decoration - it’s where prevention starts. If we want fewer repeats, fewer surprises, and stronger patient protection, we must elevate CAPA from a workflow to a mindset.

The era of “private” audits is effectively over—particularly the idea that internal or vendor audit outcomes can remain invisible to regulators. QMSR is a major wake-up call to stop treating quality as a paperwork exercise and start operating it as a real-world patient safety and risk-management system. This is at least true for med tech organisations operating under US FDA jurisdiction.
