We're proud to announce that Marashlian & Donahue, PLLC, The CommLaw Group has secured a significant win in Illinois circuit court that will benefit telecommunications providers across the state. The Result: The court ruled that municipal permit application fees for fiber optic building permits violate Illinois law and enjoined the City of Waverly from enforcing these charges. Why It Matters: This decision establishes that Illinois municipalities cannot impose new fees on telecommunications retailers for public right-of-way use—including those disguised as "cost-recovery" charges for regulation. The Impact: • Establishes strong precedent to challenge similar fees across Illinois • Removes unlawful barriers to fiber deployment and network expansion • Paves the way for faster, more cost-effective broadband rollout for communities This ruling comes at a critical time as federal regulators are also streamlining deployment processes, creating momentum at both state and federal levels for infrastructure development. Our advice to telecom providers: Review your municipal fees now. Many charges previously accepted as routine may actually violate state law and can be successfully challenged.
